WHAT THE GUIDANCE SAYS

The builders
are next door.

Building work has rules about when, and about shared walls.

Councils in England commonly recommend set hours for noisy work, and the Party Wall etc. Act 1996 says when a neighbour must tell you before working on a shared wall or digging near your foundations.

Party wall notice is set by national law.

Choose what is happening
Drilling at 10am on a TuesdayUsual hours

This falls inside the 8am to 6pm weekday hours many councils recommend. Builders are still expected to use the best practicable means to keep noise down.

Noisy work at 7am on a weekdayOutside usual hours

This is before the 8am start councils commonly recommend. Councils such as Milton Keynes offer a way to report construction noise, and can set a site's hours with a Section 60 notice.

Noisy work on a SundayUsually not expected

Many councils say no noisy works on Sundays or bank holidays. Exceptions include emergencies and work with prior consent under Section 61.

They want to cut into our shared wallTwo months' notice

Work to a party wall needs a party structure notice at least two months before it starts. If you do not respond within 14 days, a dispute is deemed to have arisen.

Excavation within 3 metres of your building and deeper than its foundations, or within 6 metres in some cases, needs notice at least one month before it starts.

8–6 weekdays

Usual weekday hours for noisy work

Maldon, Camden, Milton Keynes and Tendring councils all give 8am to 6pm Monday to Friday and 8am to 1pm on Saturdays. Tendring adds that site vehicles should not arrive before 7.30am or leave after 7pm.

Woking Borough Council says not complying with its construction noise controls can lead to prosecution and a fine of up to £20,000.

FOUR STEPS FOR NEIGHBOURS

Calm steps,
in order.

Most building work passes without a dispute. These steps follow what the council and GOV.UK guidance describes.

  • Check your council's hours

Hours are set locally. Many English councils use 8am to 6pm on weekdays and 8am to 1pm on Saturdays.

  • Use the site contact

Camden expects sites to display a working telephone enquiry line and to tell neighbours about over-runs when practicable.

  • Report noise outside hours

Councils such as Milton Keynes and Woking let residents report construction noise outside permitted hours.

  • Reply to a party wall notice

Answer within 14 days. If you do not, a dispute is deemed to have arisen and surveyors are appointed to settle it.

PARTY WALL BASICS

A shared wall,
shared say.

The Party Wall etc. Act 1996 covers new building on the boundary, work to an existing party wall, such as cutting into it or removing chimney breasts, and digging near and below a neighbour's foundations. It is separate from planning permission and building regulations approval.

The owner doing the work must give notice, and is responsible for making good any damage caused by the works. A surveyor agreed between the owners can settle a dispute, or each owner can appoint one.

Questions

Questions people ask

Are building work hours the same everywhere?

No. Hours are set by each council. Maldon, Camden, Milton Keynes and Tendring all recommend 8am to 6pm Monday to Friday and 8am to 1pm on Saturdays, with no noisy work on Sundays or bank holidays.

Can builders ever work outside those hours?

Yes, in emergencies, or with prior consent from the council under Section 61 of the Control of Pollution Act 1974. Camden says applications should be made at least 28 days ahead.

What can the council do about a noisy site?

Under Section 60 of the Control of Pollution Act 1974, a council can serve a notice controlling noise and vibration from a building site, including the hours of working.

Does a party wall notice mean I can stop the work?

Not exactly. The Act gives a framework for agreeing or resolving disputes. You can agree or disagree; if you disagree or do not respond within 14 days, surveyors settle how the work is done.

Who pays if the work damages my house?

The explanatory booklet says the building owner is responsible for making good any damage caused by the works.
